Washington Single Family Fund III LLC appealed the February 12, 2026 written determination of the Director of Planning that as of January 1, 2026 data center use on the 89.3-acre property at 1931 Old Bermuda 100 Road (Employment Center District, Bermuda Magisterial District) requires conditional use approval and is not permitted by right. Appellant claimed a vested right and challenged the Director's authority to issue the determination. Board upheld the Director's determination 5-0, denying the appeal. Underlying site-plan dispute is in circuit court litigation. Approximately 100 emails and numerous residents spoke in opposition.
