OB-17-2026 Walmart Drone Delivery - Ernest Barrett Pkwy

Apr 21, 2026

Walmart (applicant Rachel Sutherland) sought to amend the stipulations and site plan on a 2000-era rezoning (Z111 of 2000) to allow a Wing drone delivery nest in the parking lot. Staff recommended denial on visual-integrity and original-design-intent grounds. The Board denied OB-17 (Ernest Barrett) 5-0 with prejudice, which locks the application out for 12 months; a commissioner who pressed the wrong button noted the error rather than forcing a re-vote, and the outcome stood as a unanimous denial. The companion OB-16 Johnson Ferry drone nest was also denied 5-0 the same day over staff denial, with 51 opposed at the hearing and roughly 900 petition signatures.

Full breakdown

Cobb County, Georgia decides rezonings and land use permits at the Board of Commissioners' zoning hearing, with the Planning Commission recommending first and the Board of Zoning Appeals handling variances on its own track. Here the staff report carries weight that it does not carry everywhere.

We paired 11 cases where Cobb's professional staff recommended denial to how the vote actually landed: 5 were denied, 3 were sent back or continued, and only 3 were approved over staff. In other words, when staff says no in Cobb, the no sticks more often than it flips.

That is the opposite of the override markets where a council approves nearly everything its own staff recommended denying. The headline approval picture is still healthy.

On the binding BOC zoning track the Board approved 32 land-use items and denied 8, an approval rate around 80 percent, and roughly half of approvals carry conditions or stipulations. So most well-built applications clear.

The risk is concentrated and readable: it shows up when staff recommends denial and the neighborhood shows up to oppose.

On April 21, 2026 the Board denied both of Walmart's Wing drone-delivery nest requests 5-0 over staff denial, one of them with prejudice, which locks the application out for 12 months. The same day it denied a livestock lot-size reduction 5-0.

In May it denied a Racetrac convenience-store rezoning 5-0 and a goat lot-size variance, and in June the Planning Commission recommended denial 4-0 on the Bells Ferry workforce-housing townhomes (that case was then continued at the binding BOC level, not denied outright).

We are still gathering data in this market, and the structured pairing already corrects what an automated first pass missed: the staff-denial cases that looked unresolved are in fact resolvable, and they break toward staff. For a developer, the actionable read is simple.

Approval is the base case in Cobb, but a staff recommendation of denial is a genuine warning here, not a formality, and a denial with prejudice can cost you a year.

The verdict shows which staff objections this Board has actually sustained, which it negotiated into a continuance, and which three it overrode, so you know before you file whether you are walking into a fight you can win.

Frequently Asked Questions

Zoning in unincorporated Cobb County is administered by the Community Development Agency's Zoning Division. The Planning Commission acts as an advisory body that reviews rezoning, land use permit, and variance requests and makes recommendations, while the Board of Commissioners (BOC) is the governing authority that makes the final decision. The Planning Commission's duties are set out in the Cobb County Zoning Ordinance (Chapter 134).

The Cobb County Planning Commission holds its zoning hearings on the 1st Tuesday of each month at 9:00 a.m., with no hearing held in January. Hearings take place in the Public Meeting Room on the second floor of the David Hankerson Building, 100 Cherokee Street, Marietta, Georgia.

The Board of Commissioners holds its zoning hearings on the 3rd Tuesday of each month at 9:00 a.m., again with no hearing in January. Like the Planning Commission hearings, these are held in the Public Meeting Room on the second floor of the David Hankerson Building, 100 Cherokee Street, Marietta, Georgia. The BOC's hearing typically follows the Planning Commission's recommendation earlier in the month.

Cobb County's zoning regulations are in Chapter 134 (Zoning) of the Official Code of Cobb County. The code establishes and enumerates the county's zoning districts, including single-family residential districts such as R-80, R-30, R-20, R-15, and RA-6, along with commercial, office, and industrial districts. Each district's regulations appear in Article IV of Chapter 134.

The Unified Development Code is a project to consolidate Cobb County's development regulations, currently spread across Chapter 134 (Zoning), Chapter 110 (Subdivision), Chapter 66 (Historic Preservation), and Chapter 58 (Floods), into a single document. Its goals are to reduce duplication, eliminate inconsistencies, and make the rules easier to understand. The county states the UDC is not intended to rezone property or change the use of any parcel; it updates outdated regulations while keeping existing zoning designations.
