The Canals PD rezoning, 153 acres at Broad/Matlock/Heritage/Regency
Approved.
First reading approved of Stillwater Capital, Inc. request to rezone 153.073 acres from PD (The Reserve) to PD for commercial, residential and institutional uses at 240 and 260 North Mitchell Road, 240 Heritage Parkway, 2500 East Broad and 351 North Miller. The plan has four sub-districts: Canals, Neighborhood, Broad Street and Employment. It allows a maximum of six apartment blocks on up to 30% of the site, with releases tied to commercial milestones of 30k to 300k sq ft. Structured parking for canal apartment blocks drops from 90% to 70%. The plan includes up to roughly 400k sq ft of retail and a minimum 12% public open space. Council raised concerns about several applicant changes: the optional POA, removed commercial-ready space, the extended-stay hotel allowance, thin brick, the 70% structured parking, surface parking along water features, 600-ft blocks, and phasing teeth. The motion was initially misread as 26-2778 and corrected. A master development agreement will come with second reading. Planning and Zoning Commission recommended approval on August 6 subject to continued refinement.
