Zoning Decisions This Month

Six-month interim ordinance moratorium on site plan review

Denied.

Proposed six-month interim ordinance (moratorium) prohibiting acceptance of site plan reviews for non-residential projects, August 1 through January 31, to allow staff to study appropriate buffers between residential and non-residential uses. Triggered by the Balsam Lane assisted living (Balsam) and Opidon industrial projects near residences. Commission moved to deny approving the moratorium; passed, with Commissioners voting no on the denial (dissent noted in debate by Keith and one other). Motion to deny carried.

Amend preliminary plat and PUD of Sundance Greens 12th Addition

Deferred.

Applicant Tom Dean requested preliminary plat approval of Sundance Greens 12th Addition plus amendment to original preliminary plat and PUD. Original 2018 approval was 563 units (670 in 2017 concept); 12th Addition reduces lots from 58 to 48 and reconfigures streets. Includes relocating a 6,000 sq ft golf-course maintenance building to the northeast corner near Braeburn Trail homes, with requested deviations (reduced building setback 25 ft vs 50 ft PR, reduced driveway setback, landscape buffer, parking stall size, second driveway on Polaris Lane). Staff recommended tabling because the zoning map is in error (proclaimed lots rezoned PR to R-3 in 2018 never shown). Tabled until August pending city-attorney opinion and re-posting of hearing to include rezoning.

Ordinance 2026-13 amending zoning table of uses

Approved.

Amendment to city code table of uses. Corrects a decades-old typo in the Public Recreation (PR) district and makes accessory buildings a conditional use, with a permitted-use exception for structures 1,000 sq ft and under. Also amends the Village Mixed-Use (VM) district to make both light industrial and medium industrial conditional uses (previously light was conditional, medium permitted). Motion by David to approve with 1,000 sq ft minimum and the VM industrial change; carried (Sarah favored 500 sq ft/expressed reservation). Applies prospectively, not retroactively; PUD-approved items remain covered by the PUD.

Ordinance amendment on accessory building use in PR district

Approved.

Public hearing on ordinance amendment 26XX to correct zoning-code table-of-uses designation for accessory buildings in the Public Recreational (PR) district (Elm Creek Park Reserve, City Parks, Dayton Elementary, Sundance/Dayton Golf Course). Staff recommended striking the highlighted last sentence and making accessory buildings a permitted use; Commission instead moved to amend the code by changing the 'F' to 'C' (conditional use) and keep the highlighted language. Passed.

Six-month interim ordinance moratorium on preliminary plat acceptance

Approved.

Adopted a six-month interim ordinance (moratorium) prohibiting the city from accepting preliminary plats citywide, August 1, 2026 through January 31, 2027. Not applicable to concept plans, final plats, or preliminary plats submitted before August 1. Intended to relieve staff workload following departure of planner Hayden Stensgaard. An amendment to exclude Dayton Creek Addition (southwest of I-94) failed for lack of a second. Main motion adopted 4-1.
